Terms of Service — Presgraphics Analytics

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Presgraphics Analytics platform and services (the “Service”) provided by Presgraphics (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Presgraphics Analytics is a website analytics platform that provides:

Real-time website visitor tracking and analytics
B2B company identification from website traffic
Integration with Google Analytics 4, Search Console, and Google Ads
AI-powered data analysis and insights
SEO and Answer Engine Optimisation (AEO) analysis
Lead management CRM with Google Sheets integration
Branded client portal dashboards

3. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain and promptly update your account information
Maintain the security of your password and accept all risks of unauthorised access
Notify us immediately if you discover any security breach

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

4.1 Pricing

The Service is offered at a flat rate of ₹900 per month (plus applicable GST at 18%) for the Complete Analytics Suite, which includes all features. Pricing is subject to change with 30 days' prior notice.

4.2 Free Trial

New accounts receive a 14-day free trial with full feature access. No credit card is required to start the trial. At the end of the trial, you must subscribe to continue using the Service.

4.3 Billing

Subscriptions are billed monthly or annually in advance. Payments are processed through secure Indian payment gateways. All fees are non-refundable except as expressly stated in these Terms.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws, regulations, or third-party rights
Track users without proper consent or legal basis
Collect sensitive personal information (health data, financial data, etc.) through our tracking without appropriate safeguards
Attempt to reverse-engineer, decompile, or disassemble the Service
Interfere with or disrupt the Service or its infrastructure
Use the Service for competitive analysis or to build a competing product
Exceed reasonable usage limits or abuse API endpoints
Share your account credentials with unauthorised parties

6. Data Ownership and Usage

6.1 Your Data

You retain all ownership rights to your data. We do not claim any ownership over the analytics data collected from your websites or the content you create within the Service.

6.2 Our Use of Data

We may use aggregated, anonymised data derived from the Service for product improvement, research, and benchmarking purposes. This data will never identify you or your website visitors individually.

6.3 Data Processing

We process your data in accordance with our Privacy Policy, which forms an integral part of these Terms.

7. Third-Party Integrations

The Service integrates with third-party services including Google Analytics, Google Search Console, Google Ads, and Google Sheets. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or content of third-party services.

8. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Presgraphics and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

9. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable prior notice. We are not liable for any downtime resulting from factors beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Presgraphics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the total amount paid by you to Presgraphics in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Presgraphics, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after such changes constitutes acceptance of the modified Terms.
